SUMMARY:Litigation Against Sponsors: Enforcing Form I-864\, Affidavit of Support
DESCRIPTION:Almost every immigration lawyer has seen the Affidavit of Support\, but are you aware of how widely this contract has been enforced in court? While the government rarely pursues reimbursement\, sponsored immigrants have a private right of action against sponsors. This has lead to successful state and federal litigation across the country. Greg McLawsen (Sound Immigration) is an attorney based in Seattle who focuses on representing plaintiffs in these lawsuits. This talk will address:\n\n\nWhat are a sponsor’s duties under the I-864?\nNuts and bolts of enforcement: who gets sued\, where and how?\nFederal vs. state court.\nWhat defenses are available?\nPractice implications for firms handling family-sponsored immigration.\nWritten materials available here (6 articles).\n\n  \nRegister here: \nhttps://aila-org.zoom.us/meeting/register/tJIlde2ppz4oGN0V_C4sqrS3bdLAH4wlhqOY \nAfter registering\, you will receive a confirmation email containing information about joining the meeting.

SUMMARY:Immigration Legislation Across New England (State Legislative Relations Panel)
DESCRIPTION:The AILA New England Chapter draws on members from across the region. Each New England state is rich with their own history\, has different populations\, and each state has varying local immigration needs. Please join colleagues from across New England in an open forum discussion on local immigration issues in Massachusetts\, Vermont\, Maine\, New Hampshire\, and Rhode Island. We will discuss advocacy resources\, pending bills\, and dissect the current political climate post-election. \nRegister here: https://us06web.zoom.us/meeting/register/tZ0tduysqzkjGtRNvzff4c8EFTKDUagqHw5B

SUMMARY:Giving Tuesday: Listen to Kamala – Roll Up Your Sleeves and Pitch in!
DESCRIPTION:On Nov. 6\, Kamala said “You have the capacity to do extraordinary good in the world . . . This is not a time to throw up our hands. This is a time to roll up our sleeves.”  So let’s get going!  Join colleagues for a virtual roundtable on Giving Tuesday (Dec. 3) from noon to 1 to see which volunteer opportunity is right for you.  We know everyone can’t do everything\, but if each of us took on one (more) pro bono case\, or volunteered at one more clinic\, what an amazing impact that would have.  Join at this link! \nYou will be joined by: \n–        Daniel Carpenter\, to discuss AILA’s Military Assistance Program \n–        Katie Lambing\, to discuss The Rian Immigrant Center’s Immigration Clinics \n–        Justin Fyten\, to discuss direct representation opportunities with Kids in Need of Defense \n–        Sarah Allar\, to discuss direct representation opportunities with the PAIR Project \n–        Jessica Chicco\, to discuss clinic opportunities with the MIRA Coalition \nYou will hear from each represented organization about: \n–        What volunteer options are available and most needed? \n–        What is the typical time commitment (both in overall time spent and how long the case/project takes)? \n–        What if any mentorship or resources are available? \n–        Is prior experience in a specific area needed? \n–        What exactly is the next step for someone who wants to get started? \nBut wait\, there’s more! Everyone who attends will be entered into a raffle and a randomly selected winner will get to select the non-profit of your choice for a $100 donation in your name (covered by AILA New England). And everyone who commits to a volunteer or pro bono opportunity by the conclusion of the brownbag will be entered into a drawing for a $100 gift card for a wellness-related purpose. \nIf you have questions\, just come😊.  If you have suggestions or can’t make it and have questions\, please email Robin Nice at PastChairAILANE@gmail.com.

SUMMARY:AILA NE Connected: Navigating the Trump 2.0 Storm (Open Forum)
DESCRIPTION:AILA NE Connected: Navigating the Trump 2.0 Storm \nAs we all digest the post-election results\, we are feeling uncertain\, stressed\, perhaps even angry\, and probably a whole range of other emotions—that is why connectedness and solidarity is more important than ever. Join us at AILA NE Connected: Navigating the Trump 2.0 Storm\, a supportive space for AILA NE attorneys to connect\, commiserate\, and strategize. Held twice monthly – 1st Wednesday of the month at 12 pm (join here) and 3rd Tuesday of the month at 5 pm (join here)\, this forum is designed to empower and sustain you as you face unprecedented changes and challenges\, both professionally and personally. \nWhether you’re grappling with: \n\nNew or intensifying travel restrictions\,\nManaging DACA clients under shifting policies\,\nResponding to mass deportation efforts\,\nSupporting business clients navigating new standards for common work visa\, DOL wage rules or other restrictions\,\nOr just feeling the weight of this turbulent environment\,\n\nAILA NE Connected is here for you. The AILA NE Wellness Committee and the Executive Committee will provide a space to discuss legal strategies\, share advice\, and simply vent about the stresses we all feel. Many of our members work in solo practices or work remotely—so they often don’t feel connected.  This forum is designed to provide a safe and supportive space twice a month so you can feel connected to your AILA colleagues.  Together\, we can problem-solve\, find creative solutions\, and remind each other that we’re not alone in this fight. \nNo need to register in advance—and you don’t have to stay for the full hour\, or come every session—drop in whenever you are able.  Just bring yourself and whatever is on your mind. We will stand together as advocates \, allies\, colleagues and friends.  We will get through this together!

SUMMARY:AILA NE Webinar: EB-5 Hot Topics
DESCRIPTION:EB-5 Hot Topics \nWhere: Register here \nWho: AILA NE Chapter members Doug Hauer and Bernie Wolfsdorf together with AILA EB-5 Committee Vice Chair Joey Barnett to learn more about how to file EB-5 cases while visa numbers are available. \nWhat: Great opportunity for AILA members interested in EB-5 cases. Note E in the January Visa bulletin that warned about: VISA AVAILABILIY IN THE EMPLOYMENT FIFTH PREFERENCE (EB-5) SET ASIDE CATEGORIES \nThe Department of State and USCIS note increased I-526E petition approvals\, and both agencies see increasing numbers of individuals processing their applications to completion in the EB-5 set aside categories.  It may become necessary to establish Dates for Filing and Final Action Dates during the fiscal year to ensure that issuances in these categories do not exceed annual limits.  This situation will be continually monitored\, and any necessary adjustments will be made accordingly.” \nUSCIS has advised\, and the February Visa Bulletin confirms\, that only Final Action Dates (Chart A) may be used for concurrent EB-5 filing. Dates for Filing (Chart B is closed) for employment cases and most likely will not reopen until October 2025. The panel will also cover: \n\nBest practices for EB-5 Investor client intake\nRed flags to look out for in terms of transactions that may make unrealistic promises\nSecurities law basics immigration lawyers must know\nComplex source of funds issues\, including loans and partial funding\nHow to know your client may need a “red flag report” issued by a third party to strengthen a USCIS adjudications process\nQ&A
