SUMMARY:AILA NE Webinar: EB-5 Hot Topics
DESCRIPTION:EB-5 Hot Topics \nWhere: Register here \nWho: AILA NE Chapter members Doug Hauer and Bernie Wolfsdorf together with AILA EB-5 Committee Vice Chair Joey Barnett to learn more about how to file EB-5 cases while visa numbers are available. \nWhat: Great opportunity for AILA members interested in EB-5 cases. Note E in the January Visa bulletin that warned about: VISA AVAILABILIY IN THE EMPLOYMENT FIFTH PREFERENCE (EB-5) SET ASIDE CATEGORIES \nThe Department of State and USCIS note increased I-526E petition approvals\, and both agencies see increasing numbers of individuals processing their applications to completion in the EB-5 set aside categories.  It may become necessary to establish Dates for Filing and Final Action Dates during the fiscal year to ensure that issuances in these categories do not exceed annual limits.  This situation will be continually monitored\, and any necessary adjustments will be made accordingly.” \nUSCIS has advised\, and the February Visa Bulletin confirms\, that only Final Action Dates (Chart A) may be used for concurrent EB-5 filing. Dates for Filing (Chart B is closed) for employment cases and most likely will not reopen until October 2025. The panel will also cover: \n\nBest practices for EB-5 Investor client intake\nRed flags to look out for in terms of transactions that may make unrealistic promises\nSecurities law basics immigration lawyers must know\nComplex source of funds issues\, including loans and partial funding\nHow to know your client may need a “red flag report” issued by a third party to strengthen a USCIS adjudications process\nQ&A
