This training covers how to seek attorneys’ fees and costs under the Equal Access to Justice Act (EAJA) in immigration habeas cases. In some circumstances, EAJA allows prevailing habeas petitioners to recover fees from the federal government, including compensation for both the habeas litigation and the EAJA fee motion itself. Fee awards are not tied to whether—or how much—a client paid counsel, making EAJA available in pro bono and low-bono cases. Participants will learn EAJA eligibility requirements, filing deadlines, and practical guidance for preparing an EAJA motion, including procedural and substantive considerations, assignment of fees to counsel, and documenting and calculating fees and costs.
